Terms of Service

1. Acceptance

Welcome to Day of the Dead Pet ("Day of the Dead Pet," "we," "us," or "our"). These Terms of Service ("Terms") govern your access to our AI-powered pet memorial video service at https://dayofthedeadpet.org (the "Service").

By creating an account, purchasing a memorial video, or otherwise using the Service, you confirm that you: (a) are at least 18 years old; (b) have read and agree to these Terms; (c) agree to our Privacy Policy and Acceptable Use & AI Content Policy; and (d) have authority to bind yourself or the organization you represent.

If you do not agree, do not use the Service. Continued use after we update the Terms constitutes acceptance of the revised Terms.

2. Description of the Service

2.1 What we provide

Day of the Dead Pet lets you upload a photo of a deceased pet and purchase a short, stylized Día de los Muertos–themed memorial video generated with AI image-to-video technology.

2.2 Digital delivery

The Service is a digital SaaS product. After payment is confirmed, we process your order and deliver access to your memorial video through the Service. Because delivery begins promptly, refunds are limited as described in Section 7.

2.3 AI models (disclosure)

Memorial videos are generated with a single, fixed third-party model:

We do not currently offer other video models (such as Kling, Google Veo, Seedance, or Runway) on this site. Scene text is chosen from our catalog; you cannot enter custom prompts. Output quality, processing time, and availability depend on DashScope. We will notify users of significant outages when reasonable.

3. Accounts

3.1 Registration

You must provide accurate information when registering. You are responsible for safeguarding your credentials and for all activity under your account.

3.2 Security

Report unauthorized use to cyinkwan61@gmail.com. Do not share your password. Keep your billing email valid.

3.3 Organization accounts

If you register on behalf of a company or organization, you represent that you are authorized to bind that entity.

4. Products and pricing

We sell one-time memorial video orders (currently a single clip product priced on our create and checkout flows). Current pricing is shown at checkout in USD unless otherwise stated. We may change prices for future orders; changes do not affect completed purchases.

5. Billing and payment

5.1 One-time purchase authorization

Each purchase is a one-time transaction. By completing checkout, you authorize Day of the Dead Pet to charge your selected payment method for the amount shown at checkout.

5.2 Payment processor

Payments are processed by Waffo Pancake, our PCI-DSS compliant payment partner. Card details are handled by Waffo Pancake and are not stored on our servers.

5.3 Taxes

Prices may exclude applicable sales, VAT, or GST unless stated otherwise. We collect tax where required by law.

6. Your content and uploads

You retain ownership of photos and text you submit ("Input"). You grant us a limited, non-exclusive license to use Input solely to provide the Service (including sending it to our AI and storage providers). We do not use your pet photos to train public AI models without your separate consent.

You represent that you have the right to upload each photo (e.g., you own it or have permission) and that Input does not violate any third-party rights or law.

7. Refund policy

Because the Service delivers digital content promptly:

• General rule: Fees are non-refundable once video generation has started or the memorial video has been delivered, except as below.
• Duplicate charges: Full refund for proven billing errors or duplicate charges.
• Service failure: If we fail to deliver a paid video due to a verified fault on our side and cannot remedy within a reasonable time, we will refund or re-process at our discretion.
• Statutory rights: Nothing in these Terms limits mandatory consumer rights in your jurisdiction (including applicable cooling-off rules where they apply to digital content).

To request a refund, email cyinkwan61@gmail.com with subject Refund and include your account email, order ID, and reason. We confirm within 2 business days and process approved refunds within 5–10 business days to the original payment method.

Refunds are not available for accounts terminated for violating these Terms or our Acceptable Use Policy.

8. Billing disputes

If you believe a charge is incorrect, contact cyinkwan61@gmail.com with subject Billing before initiating a chargeback with your bank. We respond within 2 business days and aim to resolve confirmed errors within 5 business days.

9. AI output and intellectual property

9.1 Output ownership

Subject to these Terms, the memorial video output generated for your order is licensed to you for personal, non-commercial use (sharing with family, social memorial posts, etc.). Commercial resale or sublicensing of output requires our written permission.

9.2 Accuracy and review

AI output may not perfectly resemble your pet or meet subjective expectations. You are responsible for reviewing output before sharing publicly.

9.3 Our IP

The Service, branding, software, and site content (excluding your Input and licensed output) remain our property or our licensors'.

10. Acceptable use & AIGC content standards

Because the Service generates AI video from your uploads, you must follow our full Acceptable Use & AI Content Policy. In summary, you must not use the Service to generate, facilitate, or distribute:

1. Pornography / NSFW content
2. Violence / gore (graphic or shock content outside respectful memorial context)
3. Hate speech
4. Child-unsafe content (CSAM) — zero tolerance
5. Deepfakes / impersonation of real people (this product is for pets only)
6. Copyright / trademark infringement

You also agree not to: break the law; upload material you lack rights to use; build malware or phishing tools; circumvent security; scrape at scale; resell access; or use inputs/outputs to train competing AI models without our written consent.

Reporting: Email cyinkwan61@gmail.com with subject Content report.
Moderation: Automated checks (fixed prompts, negative prompts, DashScope provider safety, rate limits) plus human review of reports — see the Acceptable Use Policy for severity tiers and timelines.
Enforcement: Warnings, removal, suspension, permanent ban, and cooperation with authorities for critical violations.

11. Privacy and data

Your use of the Service is governed by our Privacy Policy. Payment card data is processed exclusively by Waffo Pancake. After account cancellation, we retain account data as described in the Privacy Policy (typically 90 days, then deletion).

12. Disclaimers and limitation of liability

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR ACCURACY OF AI OUTPUT.

AI disclaimer: Memorial videos are artistic, AI-generated tributes. They are not factual records and must not be relied on for legal, medical, or other professional decisions.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DAY OF THE DEAD PET IS NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE IS LIMITED TO THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.

13. Term and termination

These Terms apply while you use the Service. We may suspend or terminate access for material breach, fraud, or legal requirement. You may stop using the Service at any time and request account deletion via cyinkwan61@gmail.com.

14. Governing law and disputes

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-law rules. Before formal proceedings, contact cyinkwan61@gmail.com to seek informal resolution.

15. General

We may update these Terms; material changes will be notified at least 14 days before they take effect when practicable. If any provision is unenforceable, the rest remains in effect. These Terms together with the Privacy Policy are the entire agreement between you and Day of the Dead Pet regarding the Service.
